Probate and Estate Administration is the legal process through the Court that determines the heirs of the deceased person and the disposition of the deceased person’s personal property and real estate after death, whether the deceased person died with a validly signed Last Will and Testament or whether the deceased person died without a Last Will and Testament.
Probate and estate administration services provided to clients in North Carolina and South Carolina includes assistance with the probate and fiduciary laws that apply to the estate administration process and assistance with the completion of administration tasks including, but not limited to, the following:
- Qualification as executor or administrator in North Carolina or as personal representative in South Carolina
- Identification and collection of the deceased person’s assets
- Inventory of personal and business property
- Examination of and impact of death on title to real estate parcels
- Settlement and payment of debts by communication with creditors
- Examination of the deceased person’s life insurance policies and other accounts
- Administration of trusts
- Small estates, summary administration, or years allowance filings
